Abstract
Based on Islamic law and positive law on research data, it can be concluded that divorce outside the court brings more harm than benefit. Because with a divorce outside the court, the divorce actor will not get a divorce certificate and his rights are neglected. So, in order to avoid an accident, it is necessary to take steps to prevent it, namely by getting a divorce before a court session.
