Abstract

Name Iim, NIM. 20801007, The Concept of Kafa’ah in Marriage (Understanding Madrasah Aliyah Teachers of Rejang Lebong State), thesis, Graduate Program of IAIN Curup, Study Program of Islamic Family Law (HKI), 2022. Kafa’ah in marriage is the existence of equality in position, comparable in social level, religion, descent, and wealth. Madrasah Aliyah Negeri Rejang Lebong, a religious-based educational institution, all teachers should understand the concept of kafa’ah but in reality they have different views. Differences in interpretation of the understanding of the concept of kafa’ah based on the thoughts of the MAN teacher invite further interest, so this study aims to describe the understanding of the MAN Rejang Lebong teacher towards the concept of kafa’ah and to be able to analyze the review of the concept of kafa’ah in marriage on the understanding of teachers at MAN Rejang Lebong. This study uses a qualitative approach with the source of data obtained from primary data in the form of interviews with MAN Rejang Lebong teachers, and secondary data obtained from interviews with colleagues and also the informant's family which aims to obtain accurate results. interviews, and documentation, which is supported by the validity of the data using time triangulation and source triangulation, as well as data analysis techniques through data reduction, data presentation and conclusions or data verification. This study concludes that the understanding of the MAN Rejang Lebong teacher about the concept of kafa’ah in marriage is quite good, although the MAN Rejang Lebong teacher does not know the term kafa’ah concept clearly, but understands substantially about the similarity of backgrounds in the selection of prospective partners. The understanding of Kafa’ah according to the Rejang Lebong MAN teacher is a balanced and rhythmic concept that is important to be applied in considering the selection of a prospective partner in terms of religion, property, lineage and physical. While the review of the concept of Kafa’ah in marriage on the understanding of teachers at MAN Rejang Lebong is in accordance with what is recommended in Islamic law by prioritizing religion over physical, property and lineage criteria, because it is considered that these elements are ideal to be implemented in selecting and sorting out potential partners, and the concept of Kafa’ah does not become valid in marriage because it is not a condition and pillar, meaning that if a person marries without considering Kafa’ah, the marriage is still valid.
